Executive Order 15-15 Amending Executive Order 07-05 Emergency Planning September 29, 2015 WHEREAS, Executive Order 07-05 re-established the Rhode Island Emergency Response Commission; and WHEREAS, paragraph 4 of Executive Order 07-05 provides that the Emergency Management Agency, in coordination with the Department of Labor and Training, shall have the lead on implementing sections 311 and 312 of the Superfund Amendments and Reauthorization Act of 1986, 42 U.S.C. §§ 11001-11050 (the "Act"); and WHEREAS, this Administration has determined that certain reporting functions under sections 311 and 312 of the Act are appropriately performed by the Rhode Island Department of Environmental Management. NOW, THEREFORE, I, GINA M. RAIMONDO, by virtue of the authority vested in me as Governor of the State of Rhode Island and Providence Plantations, do hereby amend Section 4 of Executive Order 07-05 to read as follows: The Rhode Island Emergency Management Agency shall serve as the primary agency for implementing the Act's emergency planning and notification requirements and, along with the Department of Environmental Management, shall serve as the primary agency for implementing the Act's reporting requirements. The Emergency Management Agency, in coordination with the Department of Labor and Training and the Department of Environmental Management, shall have the lead on implementing sections 311 and 312 while the Department of Environmental Management shall continue to be responsible for implementing section 313.
