Executive Order 20-107 Hundred-and-Second Supplemental Emergency Declaration – Suspending Qualified Jobs Incentive Tax Credit Certification Period December 16, 2020 WHEREAS, on March 9, 2020, I declared a state of emergency due to the dangers to health and life posed by COVID-19 and such declaration has been extended until at least December 31, 2020; WHEREAS, aggressive and sustained efforts to slow the spread of the COVID-19 virus have been implemented since March 9, 2020; WHEREAS, the mitigation efforts have encouraged, among other things, remote work and discouraged travel except for essential workers; WHEREAS, the mitigation efforts have had the effect of delaying out-of-state employees from relocating to physically work in Rhode Island; WHEREAS, under R.I. Gen. Laws§ 44-48.3-1 et. seq. (the "Qualified Jobs Incentive Act"), the General Assembly created a program providing tax credits to eligible employers that create new full-time jobs in Rhode Island; WHEREAS, under R.I. Gen. Laws§ 44-48.3-?(a), an eligible employer that enters into an incentive agreement with the Rhode Island Commerce Corporation ("Commerce Corporation") under the Qualified Jobs Incentive Act must submit documentation that the employer has met the employment requirements specified in such employer's incentive agreement and that such documentation must be submitted within four years following the date of approval of an application by the Commerce Corporation; and WHEREAS, the delay of employees relocating to Rhode Island due to COVID-19 may result in an employer being unable to meet the certification requirement on a timely basis under the Qualified Jobs Incentive Act. NOW, THEREFORE, I, GINA M. RAIMONDO, by virtue of the authority vested in me as Governor of the State of Rhode Island, pursuant to Article IX of the Rhode Island Constitution and the Rhode Island General Laws, including, but not limited to, Title 30, Chapter 15, and Title 23, Chapter 8 do hereby order as follows: The running of the period within which a business must submit its certification for tax credit under the Qualified Jobs Incentive Act contained in R.I. Gen. Laws§ 44-48.3-?(a) is hereby suspended as of March 9, 2020 through the expiration of this Order. This Executive Order shall take effect immediately and shall remain in full force and effect through January 14, 2021, unless renewed, modified, or terminated by subsequent Executive Order.
